Terms & Conditions

The terms that govern your use of this website and any photography services you book with Artem Popovich Photography.

Introduction

These terms and conditions govern your use of the website popartproduction.co.uk and any photography services provided by Artem Popovich Photography (“we”, “us”, “our”). Please read them carefully before using the site or booking a shoot.

If you have any questions about these terms, you can contact us via the contact page before placing a booking.

Acceptance of these terms

By accessing this website or booking a service with us, you confirm that you accept these terms and agree to comply with them. If you do not agree, please do not use the website or book our services. These terms apply to consumers and business clients alike.

Use of the website

You may use this website for lawful purposes only. In particular, you agree not to:

Use the site in any way that breaches applicable laws or regulations.

Attempt to gain unauthorised access to the site, its server, or any connected systems.

Use automated tools to scrape, copy or republish content without our permission.

Misuse the site by knowingly introducing malware or other harmful material.

All content on this site is provided for general information and is subject to change without notice.

Services & bookings

Photography services are arranged as follows:

Enquiry — you send us the property details and your requirements via the contact form.

Quote — we respond with availability and a written quote, normally valid for 30 days.

Confirmation — a booking is confirmed once a date is agreed in writing and any deposit is paid.

Delivery — edited images are typically delivered within 48 hours of the shoot date unless otherwise agreed.

We reserve the right to decline or reschedule a booking where necessary.

All services are performed with reasonable care and skill in accordance with the Consumer Rights Act 2015. Your statutory rights are not affected by these terms.

Photography is a creative service. While we work closely to your brief, we cannot guarantee specific creative outcomes beyond what was agreed. Dissatisfaction based solely on subjective preference, where the agreed brief has been met, does not entitle you to a refund.

Fees & payment

Fees are set out in the quote agreed before the shoot. Unless stated otherwise:

A deposit may be required to secure your booking date.

The balance is due on or before delivery of the final images, as stated on the invoice.

We accept payment by bank transfer or card.

Late payments may incur interest at the statutory rate.

Final edited images are delivered once payment has been received in full.

Cancellations & rescheduling

We understand plans change. Our cancellation terms are:

You may reschedule free of charge with at least 48 hours’ notice.

Cancellations made within 48 hours of the shoot may forfeit the deposit.

Outdoor shoots affected by severe weather can be rescheduled at no extra cost.

If we need to cancel for any reason, any deposit paid will be refunded in full.

Force majeure — neither party is liable for failure to perform due to circumstances beyond reasonable control, including extreme weather, illness, equipment failure, or travel disruption. In such cases we will agree a new date at no extra charge.

Consumer Contracts Regulations 2013: if you book online, you have a 14-day right to cancel. However, if the shoot is scheduled within that 14-day window and you expressly ask us to proceed, you acknowledge that your cancellation right may be lost once the shoot has taken place.

Intellectual property & image rights

Copyright in all photographs and video we create remains with Artem Popovich Photography unless otherwise agreed in writing.

On full payment, you receive a licence to use the delivered images for the purpose agreed (for example, marketing a specific property).

Images may not be resold, sub-licensed or passed to third parties without our consent.

We may use the images in our portfolio and marketing unless you request otherwise in writing.

Please credit Artem Popovich Photography where reasonably possible.

Website content, including text and layout, is also protected by copyright and may not be reproduced without permission.

Your responsibilities

To help your shoot run smoothly, you agree to:

Provide safe and timely access to the property at the agreed date and time.

Ensure the property is prepared and styled before the photographer arrives.

Obtain any permissions needed to photograph the location.

Let us know of any access, safety or parking considerations in advance.

Liability & disclaimers

We take pride in our work, but you should be aware of the following limitations:

We are not liable for delays or failures caused by events beyond our reasonable control.

Our total liability for any booking is limited to the fees paid for that booking.

We do not exclude liability for death, personal injury or fraud where the law does not allow it.

The website is provided “as is”, without warranties of uninterrupted or error-free operation.

Privacy & data protection

We handle your personal data in line with our Privacy & Cookie Policy, which forms part of these terms. It explains what we collect, how we use it, and your rights under the UK GDPR.

Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from them will be subject to the exclusive jurisdiction of the courts of England and Wales.

We are not currently signed up to an alternative dispute resolution (ADR) scheme. If we are unable to resolve a complaint directly, you may seek independent advice from Citizens Advice (citizensadvice.org.uk) or your local Trading Standards office.
